INDEPENDENT Presidential candidate Panduleni Itula has approached the Namibian High Court on an urgent basis to appeal against the recent judgment handed down by the Electoral Tribunal.
Dr. Itula failed to convince the tribunal why the ECN should not use the Electronic Voting Machines and alternatively why independent IT technicians should be hired.
His appeal is currently before the High Court on the grounds that Magistrate Uaatjo Uanivi, who chaired the tribunal, misdirected himself in law by hearing the merits of Dr. Itula’s application and subsequently ruling that it wasn’t an urgent matter.
Dr. Itula is further arguing that Magistrate Uanivi is not a Regional Court Magistrate as provided for by the Electoral Act. Uanivi has been acting as a Regional Court Magistrate.
When he approached the Electoral Tribunal, Dr. Itula was represented by Henry Shimutwikeni, but for the appeal in the High Court he has enlisted the services of Titus Iipumbu.
