G4S Secure Solutions (Namibia) has filed a case management report seeking directions from the High Court to dismiss a civil lawsuit by Namib Desert Diamonds (Namdia) (Pty) Ltd, which had sued the security company for over N$300 million for negligence in relation to a diamond heist.<\/p>\n\n\n\n
This is after Namdia failed to disclose evidence it wishes to lead against G4S in the lawsuit, which, among others, includes NAMPOL investigation docket(s) and all reports, witness statements, forensic reports, scene logs, evidence registers, and chain-of-custody documentation pertaining to the alleged incident.<\/p>\n\n\n\n
Other evidence sought also includes CCTV footage and any audio recordings pertaining to the incident, as well as documents reflecting the description, valuation and quantification of the diamonds. The state diamond entity has, however, declined to disclose these and many more, citing confidentiality reasons.<\/p>\n\n\n\n
Namdia claimed that it suffered damages amounting to N$314 million, for which it claims G4S is liable, as a result of the robbery on 18 January. G4S Secure Solutions (Namibia) concluded an agreement with Namdia for the provision of full-time remote monitoring and armed response services by G4S to Namdia in May 2024.<\/p>\n\n\n\n
On 18 January 2025, one of G4S’s employees, Samuel Shipanga, who had formed part of the G4S first responders, was found to be complicit in the robbery after he stole four parcels of diamonds at the robbery scene, where diamonds had allegedly been strewn all over the ground by robbers to create a distraction.<\/p>\n\n\n\n
Namdia claimed that G4S breached its agreement with it by being \u201cgrossly negligent\u201d and that \u201cit failed to react and prevent the theft of diamonds, despite its presence at the premises at the relevant time\u201d.<\/p>\n\n\n\n
The lawyer representing G4S Secure Solutions Namibia, Charles Visser, has now sought directions from the High Court in making an application to dismiss Namdia\u2019s claim, in terms of Rule 53(2)(c), with costs, on the grounds that Namdia, without reasonable explanation, failed to comply with two court orders in relation to disclosure of evidence.<\/p>\n\n\n\n
Namdia did not comply with court orders dated 21 April 2026 and 30 July 2026.<\/p>\n\n\n\n
He added that it also declined a proposal for documents to be reviewed in an in-chambers meeting with the Managing Judge, on the basis that G4S would not be permitted to copy or photograph them.<\/p>\n\n\n\n
