A BAIL application of two suspects, namely Petrus Pandeni Uusiku and Petrus Shikwaya, who are charged with the murder of the late Ondangwa Prosecutor Justine Shiweda, was stopped in its tracks after Windhoek Magistrate Olga Maharukua ordered that the bail application matter be transferred to the Ondangwa Magistrate\u2019s Court.<\/p>\n\n\n\n
The order came after the magistrate declined requests by the legal representatives of the two accused to withdraw the charges that the accused are facing in Windhoek, as they allegedly face similar charges of murder in Ondangwa, which they argued amounts to a duplication of charges.<\/p>\n\n\n\n
The first accused in the matter, Matheus Angula, a police officer who stands accused of contravening Section 43 of the Anti-Corruption Act for using his office or position for gratification, will, however, have his case separated from that of Pandeni and Shikwaya and is set to return to court on 19 March 2026.<\/p>\n\n\n\n
It is alleged that Angula, between the period of 22 and 27 October 2025, used his position in the Namibian Police to book out a suspect, Abner Mewiliko Mateus, from the police holding cell under the pretence of taking him to the hospital, while he instead took him to Beacon Guesthouse and thereby obtained a bribe of N$1,000.00.<\/p>\n\n\n\n
It is further alleged that it is during this window period that the alleged mastermind in the murder case of Shiweda, Abner Mateus, who is a police officer, made plans to conspire with other accused in the matter to draw up a plan to murder Shiweda, who had reportedly objected to his bail despite efforts to bribe her.<\/p>\n\n\n\n
The late Shiweda (30) was shot multiple times and doused with a highly corrosive acid in the presence of her children on 17 October 2025, and succumbed to her injuries in early February 2026.<\/p>\n\n\n\n
Lawyer Joas Neemwatya, representing accused two, Petrus Shikwaya, queried whether the charges the accused face in Windhoek, which include murder, should not be withdrawn, as he said that his client had already appeared in the Ondangwa Magistrate\u2019s Court on the same charges and that the state had objected to the granting of bail at the first appearance.<\/p>\n\n\n\n
Murray Shikongo, the lawyer who represents accused three, Uusiku, reiterated the same sentiments and asked that the charges in Windhoek be withdrawn, as two different courts cannot prosecute the accused on the same charges.<\/p>\n\n\n\n
State Prosecutor Eric Naikaku, however, objected to this and asked the two defence lawyers under which provision of the law the withdrawal of the said charges in Windhoek would be made. He further argued that the charge which would be transferred does not pertain to murder but rather murder read with Section 18(2)(a) of the Riotous Assemblies Act 17 of 1956, in that the accused, during the month of October 2025 in the district of Windhoek, wrongfully and unlawfully conspired with Abner Mewiliko Mateus to murder and\/or injure Justine Shiweda.<\/p>\n\n\n\n
Naikaku said that the offence of conspiracy to commit murder happened in Windhoek, while the actual act of the murder happened in Ondangwa, and thus the charge of conspiracy should be transferred to Ondangwa to be consolidated with the other charges the accused face in that jurisdiction.<\/p>\n\n\n\n
Magistrate Maharukua ordered that the matter transfer be made as requested by the state prosecutor and that the accused would not suffer any prejudice, as any duplication of charges would be attended to in Ondangwa. The two accused are expected to appear on 16 March 2026.<\/p>\n\n\n\n
