The lawyers, however, argued that the incarceration of their clients while the State has not completed investigations would amount to an infringement on their clients\u2019 rights. They contended that if investigations remain incomplete after more than two years, the case should be struck from the roll and only re-enrolled once the State \u201chas its house in order,\u201d as their clients have the right to a fair and speedy trial. Windhoek Magistrate Esme Molefe will deliver her ruling on 3 December on whether the matter will be postponed to 2026 or struck from the roll in the meantime. The Namcor accused have been in custody since July.
