THE Magistrates and Judges Association of Namibia (MJA) has expressed distress regarding the continued failure to implement and gazette the corrected housing and vehicle allowance alignment for magistrates and has said that they will withhold their labour starting Monday, 24 November 2025.<\/p>\n\n\n\n
Florian Beukes, from the Magistrates and Judges Association, said that following meetings with the Commission and the Executive Director of the Office of the Judiciary on 4, 5, 6, and 7 November 2025, and their subsequent engagement with the Minister of Justice, Immanuel Wise, on 19 November 2025, their association was informed that the corrected schedule had been submitted to the Minister of Finance for concurrence on 12 November 2025 by the Minister of Justice.<\/p>\n\n\n\n
\u201cWe were further informed that the Minister of Finance had raised certain queries regarding the schedule. However, no written communication has been provided to us outlining what the queries entail, what the positions of the Minister of Justice and the Minister of Finance are, or what remains outstanding in the processing of the gazette. It must be emphasized that funds in the amount of N$8 million have already been made available for the implementation of these benefits. Furthermore, in the spirit of cooperation and national interest, the MJA amicably agreed to forgo back pay from April 2025 to July 2025, solely to ensure implementation without financial strain on the State,\u201d Beukes said.<\/p>\n\n\n\n
Yet, despite this significant concession, he added that there has been no clarity, no written correspondence, and no substantive progress toward implementation.<\/p>\n\n\n\n
\u201cMagistrates remain without the benefits agreed to in principle since 2 October 2023, and the contradictory and inconsistent information received verbally has created a climate of uncertainty and instability. Given the seriousness of the situation, and the absence of any written update from the Minister of Finance and the Minister of Justice, all grievances remain unresolved, and the continued failure to properly communicate or implement the agreed benefits undermines the independence, dignity, and effective functioning of the Magistracy. Accordingly, we hereby give formal notice to all addressed parties that, effective 24 November 2025, our members will exercise their Constitutional rights under Article 21(f) of the Namibian Constitution to withhold their labour until this matter is resolved and the corrected alignment is implemented and gazetted,\u201d Beukes concluded.<\/p>\n","protected":false},"excerpt":{"rendered":"
