NAMCOR Trading and Distribution (Pty) Ltd, the subsidiary company of the National Petroleum Corporation of Namibia (Namcor), the state oil company, has dragged a private construction company to court, seeking repayment of N$3 million after it failed to construct a service station despite receiving payment.<\/p>\n\n\n\n
Namcor, represented by lawyer Kommer Greunen, in its particulars of claim listed the company, Sagarias Solar Energy (Pty) Ltd, and its managing director, Joseph Shlhepo Sagarias, as respondents in the matter.<\/p>\n\n\n\n
It is alleged that Namcor signed the agreement on 17 August 2021 and made an upfront payment.<\/p>\n\n\n\n
\u201cIn terms of the agreement, the plaintiff (Namcor) and the first defendant (Sagarias Solar Energy (Pty) Ltd) agreed to co-invest in the construction and development of a service station (the project) to be known as JS Sagarias Solar Energy, situated at Erf 3160, Orwetoveni Extension 7, Otjiwarongo,\u201d Greunen said.<\/p>\n\n\n\n
He added that Namcor, on 19 October 2021, paid a sum of N$2.8 million into the bank account of Sagarias Solar Energy (Pty) Ltd as an upfront payment to contribute towards the construction cost of the service station.<\/p>\n\n\n\n
Greunen said that Sagarias and his company, however, breached the terms of the agreement and have not commenced with any construction or development as per the terms of the agreement.<\/p>\n\n\n\n
\u201cThe plaintiff exercised its right to terminate the agreement between the parties on 15 May 2024 and thereby demanded that the defendants pay over the sum of N$3 million not later than 14 days from the date of the letter of demand,\u201d Namcor\u2019s lawyer said.<\/p>\n\n\n\n
