{"id":371214,"date":"2025-03-07T19:43:31","date_gmt":"2025-03-07T17:43:31","guid":{"rendered":"https:\/\/informante.web.na\/?p=371214"},"modified":"2025-03-07T19:43:38","modified_gmt":"2025-03-07T17:43:38","slug":"tamson-hatuikulipi-applies-for-leave-to-appeal-denial-of-bail","status":"publish","type":"post","link":"https:\/\/informante.web.na\/?p=371214","title":{"rendered":"Tamson Hatuikulipi applies for leave to appeal denial of bail"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Staff Reporter<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TAMSON Tangeni Fitty Hatuikulipi, one of the 10 men implicated in the Fishrot corruption case in which over N$300 million was paid to the accused to give a competitive edge over the Icelandic company Samherji to access government objective fishing quotas, has launched an application in the High Court to allow him to appeal the refusal to grant him bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a><\/a>Acting High Court judge David Munsu in December 2024 dismissed Hatuikulipi\u2019s bail application, adding that he had not brought forth new facts to the case and failed to account for the millions paid into his accounts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state is alleging that, due to his involvement in the alleged fraud and corruption which enabled the Icelandic fishing giant Samherji to access government objective quotas, he derived financial benefits totalling about N$17 million through payments made into his personal bank accounts. It is further alleged that he received funds totalling about N$40.6 million through payments made to businesses and corporate entities he owned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the application to appeal the bail dismissal in the Supreme Court, Hatuikulipi\u2019s legal representative, Mbanga Siyomunji, argued that the learned judge erred in law and\/or fact by not considering that a lot of documentation used in the bail application, based on new facts, emanated from the additional disclosure made by the respondents on 3rd June 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Siyomunji said that documents titled P\/H letterhead, Potential meeting in Windhoek &#8211; confidential, Quotas, and Contact proved that his client had a legitimate business relationship as a consultant with Samherji and assisted it in forming joint ventures with local fishing-right holders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant testified: \u201cMy Lord, this email confirms what I have just said, My Lord. Johannes Stefansson confirms in these emails that JV2, JV5, and JV10 are in contact with Samherji through me, My Lord. These emphasise the legitimacy of the agreement between myself and Samherji.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He added that through Exhibit B33, Johannes Stefansson further wrote to the applicant and informed him that JVs 2, 5, and 7 were using the fishing vessel Heinaste and that they were expected to finish catching the 35,000 tonnes of quota by the middle of December 2013.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThrough Exhibit B34, Johannes Stefansson presented a comparison to the applicant between the fishing trawlers Heinaste and Grey Whale. This is to further demonstrate the capacity in which the applicant was operating in accordance with his consultancy service agreement.
