THE Windhoek regional court has reserved judgment in Fabian Amukwelele’s rape allegations until next Tuesday morning.<\/p>\n\n\n\n
Amukwelele was arrested in 2020 after being accused of raping a woman employed in a different division of the City of Windhoek at his flat in Rocky Crest on January 11th of that year. She reportedly became pregnant as a result of the rape, and her pregnancy was later terminated with the authorization of the magistrate’s court after the rape case was opened.<\/p>\n\n\n\n
After spending 20 days in custody, he was subsequently granted bail in the amount of N$7,000, with conditions that he may not contact the complainant or go within 100 meters of the complainant’s residence or place of employment until the matter is finalized.<\/p>\n\n\n\n
Defense lawyers, Sisa Namandje and Eino Nangolo contended that the complainant provided conflicting accounts of what transpired before she ended up sleeping over at Amukwelele’s place. They argued that she gave various contradictory answers on crucial aspects.<\/p>\n\n\n\n
The lawyers further detailed that while she made allegations of rape, her primary concern was avoiding pregnancy. The reason the case was opened months later was that she realized she was pregnant and couldn’t terminate the pregnancy without filing a case.<\/p>\n\n\n\n
“It was only after confirmation of her pregnancy during March 2020 that she travelled to the North to inform her family. It is also only after she was advised that she could not have her pregnancy terminated without opening a police case that she approached the police with the assistance of, and on instigation, it appears, of her father, Mr. Christof. The Accused was, therefore, only then arrested following the case that was opened primarily for purposes of facilitating an abortion. It is a fact that the complainant achieved what she wanted – the purported abortion was carried out. We submit that the criminal case had so much to do with the abortion \u2013 not necessarily the truth of what happened. The complainant did not want to be pregnant,” said Amukwelele\u2019s lawyers.<\/p>\n\n\n\n
In its closing submission, after calling in 10 witnesses, the state maintained that it had proven its case beyond reasonable doubts. The state submitted that the court, when considering the totality of the evidence and the merits and demerits of the case, should reject the version of the accused person, and Amukwelele should be found guilty as charged.<\/p>\n\n\n\n
Amukwelele, who is currently free on bail, is charged with rape and kidnapping. He will return to court on October 10th for the ruling on his case.<\/p>\n","protected":false},"excerpt":{"rendered":"
