SEEKING RECOURSE: Immanuel Mulunga, Suspended MD of Namcor.<\/figcaption><\/figure>\n<\/div>\n\n\nMeanwhile, Shiwana Ndeunyema has stepped down as the acting managing director of the company. Paulo Coelho, the public relations officer at Namcor, however, stated that the petroleum corporation cannot comment on the way forward at this point, as internal deliberations are ongoing.<\/p>\n\n\n\n
In his affidavit, Mulunga has argued that he has turned around the fortunes of Namcor, increasing its revenue from N$700 million when he was initially appointed to approximately N$7 billion in the last financial year.<\/p>\n\n\n\n
Mulunga is faced with three charges in the disciplinary hearing, which include fraud (withholding information from the board of directors of Namcor) regarding his intention to instruct the finance department to transfer US$6.7 million to Sungara Energies from the account of a Namcor Exploration and Production (Namcor E&P), a subsidiary of Namcor, while he had the duty to do so. The money was subsequently transferred to Sonangol to retain the oil block in Angola.<\/p>\n\n\n\n
The second charge is that he breached the conditions of his employment, causing a serious breach of trust between him and the board. The third charge states that he breached confidentiality by leaking a WhatsApp communication to the media.<\/p>\n\n\n\n
In his application, Mulunga has said that the first two charges should be set aside. “The first ground I rely on to challenge and set aside the charge sheet is that the charges have been instituted in breach of Clause 11 of the policy. I submit that the charges have not been instituted within a reasonable period of the necessary facts becoming available to the Board of Directors of the Respondent,” Mulunga said.<\/p>\n\n\n\n
According to the employment contract, Clause 11 stipulates that all disciplinary cases should be disposed of within ninety (90) days from the breach officially being brought to the attention of NAMCOR\u2026<\/p>\n\n\n\n
“I submit that it is unreasonable in circumstances where all the facts are known and where legal advice has been provided for the Respondent\u2019s Board of Directors to only commence the disciplinary process more than five (5) months after the receipt of legal advice on the correct process to follow if disciplinary action is required. I reiterate the fact that I deny that the disciplinary process has actually commenced as of 11 July 2023,” Mulunga said.<\/p>\n\n\n\n
In addition to this, Mulunga has argued that the second basis he relies on to challenge and set aside the charge sheet is that the investigation into the charges was not conducted by the Initiator but rather was conducted by a third party known as Cliffe Dekker Hoffmeyer, which appears to be a South African law firm.<\/p>\n\n\n\n
According to the Namcor employment policy, a hearing\/inquiry committee or panel will consist of the following people: 8.3.2. Initiator \u2014 the immediate supervisor or Complainant who will investigate the case and lodge a complaint.<\/p>\n\n\n\n
“I submit that, in terms of the policy, the Initiator is the only person or persona that may lawfully investigate the intended charges that are intended to be instituted on the basis of any alleged misconduct by an employee of the Respondent,” Mulunga argued.<\/p>\n\n\n\n
