THE formal bail hearing of an ex magistrate, Jaco Kennedy, who faces two rape charges before the Windhoek High Court is due to start on 19 July 2019.
Kennedy, 29, who appeared calm and collected in court today was informed that his bail application can only be heard in two weeks’ time.
He is accused of raping two women between the Windhoek central hospital and the Katutura hospital, in a secluded and bushy area in 2015 and 2016, respectively. In the first incident, him and his cousin, Ray Cloete, reportedly offered the victim a lift before raping her. They were subsequently arrested and released on bail of N$3,000 each.
In December 2016 while out on bail, Kennedy was arrested again for raping another woman in the same vicinity. He has since been incarcerated and is fighting to secure bail.
He is represented by Windhoek Lawyer Braam Cupido.
Incidentally, Kennedy this morning appeared in the same dock as another former magistrate, Melanie Theron, who was due to hear her fate on the corruption and fraud charges she faces.
Theron faced over 14 corruption charges in that she allegedly solicited, accepted and agreed to bribes totaling N$6 600 in 2001 when she was employed as a magistrate at Oshakati in 2011.
Judge Nate Ndauendapo this morning informed the accused, who is representing herself, that the judgement on conviction will only be ready by Thursday this week.
It is the state’s case that Theron canceled various warrants of arrests on traffic fines in exchange for money.
