THE bail application of medical doctor Fillemon Nakanduungile, which came to an abrupt end at Ondangwa last week when Magistrate Siegfried Geiseb recused himself, started again this week, presided over by Magistrate Billy Mutwa Lutaka from Otjiwarongo.
The accused has already made a number of significant admissions under cross-examination by both his lawyer, Petrus Elago, and State Prosecutor Tangeni Iitula. Nakanduungile indicated that he will plead guilty to some charges while maintaining his innocence on others.
He faces charges arising from an incident at Ondangwa in October last year in which State Prosecutor Justine Shiweda was shot and attacked with an acidic substance. Five other people were also arrested in connection with the incident.
Under cross-examination by Iitula on Wednesday, Nakanduungile admitted to a number of illegalities, including crossing the Namibia–Angola border illegally and failing to keep medical records of a supposed client, Abner Matheus, who is said to be the mastermind of the attack on Shiweda.
Nakanduungile’s passport, which is currently in the possession of the State, reveals that he is a frequent traveller to Angola, where he claims to have business interests. He also admitted to crossing the border illegally at least once.
The accused further revealed that three days after the 17 October attack, he contacted the victim via WhatsApp and offered his assistance.
The hearing continues today, with the police investigator in the witness stand.
