Challenge to Judge Chinhengo earlier Fishrot findings dismissed

UPDATE: Deputy Judge President Hannelie Prinsloo has dismissed an application by Fishrot accused suspects Sacky Shanghala, James Hatuikulipi and Pius Mwatelulo to set aside the appointment of Zimbabwean judge Moses Chinhengo, as well as declaring all the decisions made by the said judge as unlawful, null, void, invalid and therefore of no force and effect.

The application to invalidate Chinhengo’s appointment as a judge in general and the decisions made by the judge continued despite Chinhengo stepping down in June 2025 from his position of presiding over the Fishrot case due to personal reasons.

Shanghala argued that Chinhengo’s appointment was not, in fact, made in terms of Sub-Article (3) of Article 82 of the Namibian Constitution, and was instead done in terms of Sub-Article (1) of Article 82, which he argued does not give the president powers to appoint judges.
