Windhoek Mayor advised that management committee is unlawful, suggests self-review

LAWYER Patrick Kauta appointed to represent the Council for the Municipality of Windhoek had recently summoned the City’s Mayor, Sade Gawanas, where he advised her that the New Management committee of the city that ascended to power on 23 August was unlawfully elected.
These remarks were stated in the mayor’s explanatory affidavit submitted court, following an urgent application by the Independent Patriots for Change (IPC) Councilors, which was dismissed by court on the basis that the application was not urgent.

The legal fight ensued after the city adopted a vote of no confidence against the IPC’s Management Committee, which resulted in an attempt by the IPC to interdict the city from resolving the management committee, and was not successful.

In her affidavit, Gawanas indicated that Kauta expressed concerns about the legality on the special meeting held on 22 August and 23 August respectively. She said that the lawyer had conveyed serious alarms about the resolutions of the special meetings took place on 22 August and the elections of the Management Committee of August 2022, adding that they were unlawful and inconsistent with the rule of law and suggested that the city launches a self-review application.

The mayor, who pointed out that she will not be opposing the application by the IPC, further stated that Kauta said the New city’s leadership could not take any lawful binding decisions as they were unlawfully elected.

Gawanas recounted that there was a plan to launch an application for self-review through their legal representative Kauta but for some differences, it did not materialize.

It is further established that, despite the legally problematic concerns around the election of the new management committee, the Corporate Legal Adviser of the City had allegedly withdrawn the appointment of Kauta as the city’s representative and subsequently appointed the Sisa Namandje Inc. as the new legal representative.
