HIGH Court Judge Orben Sibeya on Wednesday ordered that the agreement between the Namibia Airports Company (NAC) and Menzies Aviation for Menzies to provide ground handling services at Hosea Kutako International Airport (HKIA) shall terminate on 30 June 2022.
This is after the NAC filed an application with the High Court, requesting an order compelling Menzies Aviation to cease providing all services at HKIA.
Menzies Aviation, which is a global provider of passenger, ramp and cargo handling services, has had the contract for ground handling services at the airport since 2014. In December 2021, the contract was awarded to Paragon Investment Holdings.
Menzies Aviation claims the tender process had irregularities and is thus unlawful.
Menzies Aviation asked the court to set aside the tender award but the application was dismissed with cost.
In his judgement, Judge Sibeya declared that Menzies Aviation shall before 30 June 2020 cease to provide ground handling services at HKIA.
The Judge also ordered that Menzies Aviation hand over all security access cards or other equipment entitling it to access HKIA or any premises that it occupies at HKIA under the ground handling services agreement with the NAC.
The High Court judgment also compelled Menzies Aviation to vacate any premises at HKIA occupied under the ground handling services agreement.
If Menzies Aviation refuses or delays to act as per the court order, Judge Sibeya further ordered that the Deputy Sheriff of the court is directed to evict Menzies Aviation from HKIA and all premises of the NAC, as well removing all equipment belonging to them.
Paragon Investment Holdings is to take over all the ground handling services as per the tender award of December 2021.
The matter is regarded as finalized and removed from the court roll.
