THE Ondonga King Immanuel Kauluma Elifas is seeking the recusal of High Court Judge Herald Geier from proceedings in which he is attempting to restrain seven suspended councillors from exercising any traditional authority or customary law over any members of the Ondonga traditional community.
This morning, King Kauluma’s legal representative, Advocate Dennis Khama and the suspended councillors’ lawyer, Elize Angula met with the Judge in his chambers to decide on 17 September as the date to hear the new application. Parties will submit their views on the application to have the judge removed on that date.
The king was given until 27 August to file his heads of argument. The six remaining councillors, Fillemon Shuumbwa Nangolo, Joseph Asino, Sheetheni Kamandja, Kashona Malulu, Fillemon Nambili and John Walenga have until 2 September to file their replies.
The councillors were dismissed by the King on allegations of gross misconduct, insubordination and misleading the community. They were accused of conspiracy and contraventions of the customary laws and practices of the Ondonga Traditional Authority.
